Summary Judgment Upheld for Brake Manufacturer Based on Statute of Limitations

Supreme Court of Minnesota, July 1, 2020

In 2009, Gary Palmer’s (the decedent) pulmonologist informed him that he had calcium deposits on his lungs due to asbestos exposure. On December 24, 2011, the decedent was diagnosed with mesothelioma and in January 2012, he learned that asbestos exposure had caused his mesothelioma. The decedent passed away on March 1, 2015.

On February 23, 2018, Appellant, Deborah Palmer, filed this action against Honeywell International (the manufacturer of Bendix brakes) (Bendix) under Minn. Stat. § 573.02, subd. 3 (2018).

Summary Judgment Affirmed Due to Insufficient Service and Statue of Limitations

MINNESOTA – The plaintiff’s decedent passed away from mesothelioma allegedly caused by his exposure to his father’s work clothes and Bendix (Honeywell) brakes. The decedent’s father was an insulator for Walker Jamar and A.W. Kuettel. The decedent also worked for four months in 1974 as a janitor at an Oldsmobile dealership. Minnesota Court of Appeals Affirms Verdict Against Honeywell

MINNESOTA —  In an unpublished opinion, the Minnesota Court of Appeals affirmed four trial rulings made by the district court. The plaintiff, Ronald Conda, filed a lawsuit in July 2015 against numerous defendants, including Honeywell, alleging asbestos exposure caused his mesothelioma. The plaintiff passed and the complaint was amended into a wrongful death action. The case was first tried before a jury in the spring of 2016. Remand Denied and Plaintiffs’ Mesothelioma Suit Dismissed Based on Lack of Personal Jurisdiction

MINNESOTA — In March 2016, the plaintiffs filed suit against multiple defendants, including Conwed Corporation, in Missouri Circuit Court in St. Louis alleging that the husband plaintiff’s mesothelioma was caused by exposure to the defendants’ asbestos-containing products, including Conwed’s ceiling tile.
